I need an Order To Show Cause to Vacate A Default Divorce Judgement against me.
It is a simple order to vacate based on lack of personal jurisdiction. (The order is untimely or would be, but regardless of the statute of limitations barring the right to seek an order, that being a year, is however trumped by other facts.
The simple and easiest one is the right for "due process" that upon showing a good reason for not showing up at court.
1st Reason, I was not served or ineffectively or improperly served, not served or defective service, bottom line I was never personally served.
The 2nd reason is that the plaintiff and her attorney committed perjury and or fraud with the presentation of false documents to the court as well as lied about their service. I live 5 houses away, line of site, I am disabled, I make my self available at any given moment that I get a call from anyone, my sons, my wife, her parents. I could shout from my doorstep and they would hear.
So I want to also have an order imposing strict criminal charges and sanctions for fraud theft altering legal documents perpetuating fraud with service. (They claim to have sent FedEx to serve me, that is no good. They got an ex parte hearing to allow service via fedex or emal. FedEx denies (to me that there was any record of a delivery left for me overnight. They said nothing unsigned for. Even following flawed reasoning fedex is no good, there is a conflict of interest. My wife and I had sued FedEx and were preparing to do so again. That would make service by them defective. They also said that they sent me an email to two email addresses. My 25 year old Yahoo email address, that I no longer use, I had not even attempted to sign in for years. But that was yahoo, I had a dozen accounts on there. If you still send emails to those addresses they will not send back an error message. But I owned a domain that I had email at and shut the server down long ago. If you message an un-hosted domain, it will send an "undeliverable" message in return. So by inference her lawyer incorrectly assumed that if he sent an email to one email address and it does not send an error then that was okay, when compared to the other that sent back a bad email or does not exist. That is flawed, they are assuming, that I would have read it?????? I get a ton of spam, that is why i moved to gmail. They also said they attempted to reach my previous lawyer and that he did not return a call. I called, left a message, and he replied the next day.
