Background: I've been hired by a band to put together a website for them, but the picture they want on the front page might be questionable. For now I just have a black dot over his nipple.

Where do you live? I suggest you do some research on the laws regarding what constitutes fobidden material.

I think you need to look into that. The 'male' is underage and I could see issues arising as a result. I would wonder about a company that wants a 16 year old males nipple as an image on their homepage. Questionable to me.

I don't think so only because there have been commercials, tv shows and more with underage guys with their shirts off. Heck, Nirvana had a CD cover with a naked baby swimming on it

Although a good lawyer, and a sucker jury may constitute that as child porn, I think its very unlikely.

I'm not a lawyer, but if it were illegal, one would imagine that any 16 yo boy would be charged for indecent exposure for walking around with a shirt off. I'm not aware of anywhere that happens, but the laws are specific to your community and the community where the boy lives. Usually the standard I've seen is arousing a prurient interest or violating community standards.

My "knowledge" is limited to the US.

@Edit: Because the child is underage, simply posting any photo might be a problem if a parent wants to push the issue. Having a signed authorization for the photos and for photos in general may be the safest route. I know I wouldn't want pictures of my daughter on the web and even revoke school permission to use images of her (through their form for permission).

It depends on the law that is implemented in your place. However, it would be better and safer for you not to put it.

I feel that it is a sad indictement of the state of peoples conciousness generally, when something as simple as this is considered in such a manner.

Open any teenage magazine and there will be far more explicit pictures . One question to ask yourself is; Would you be thinking differently if it was a 16 year old female?
