I think duplicate content has its criteria. How google think its a duplicate content? Literary speaking duplicate is a copy, but what if you just create it accidentally and make a duplicate from other site?

I dunno, it's just Google is sooo late in giving penalties to duplicate content, I even suspect they are doing so manually with Indian students and stuff. It doesn't appear to be automated at all.

Depends on how much they took from the other site. If someone copied an entire article and pasted it then yes I would think it would be considered duplicate content.

If someone took a short quote or paragraph from another forum as a conversation starter and the thread generated posts discussing things I would think that wouldn't be duplicate content.

If there is no penalty, Google ((or even other SE) might "lessen" the value of content once it was duplicated; whether its intentional or not.
