What course of action should I take when someone has been stealing my content from one of my sites? I've emailed the person numerous times and there is still no reply... what next? I've checked whois, contacted through his registrar and nothing!

There is a proceedure under The Digital Millennium Copyright Act of 1998 to send a take down notice to the web site owner. If that does not get results, you will need to retain an attorney who will see that your issues are taken care of.

Surely as an "attorney" you must know that he DMCA only applies in the US jurisdictions.

For EU countries the European Union Copyright Directive applies.

It is very, very difficult if it's not in the same country. Even in the same country it can be a drag with attorney. However, this is copyright infringement and should be taken to court.

If you are willing to do so, inform him that you will be in contact with you attorney within 5 days if he hasn't taken any action to remove the stolen content.

I had a similar problem last week. I had a writer buy numerous blog articles from me, list them on her sites and then issue a chargeback through paypal (they always side with the buyer). I told her that as she had been refunded she needed to remove my content from her sites. I knew I couldn't resell the content but I wanted her to know that she could also not get away with scamming people.

Initially she refused, but once I told her that I would be taking the matter further and contacting my lawyer she removed the content. Aside from that you could also contact the website host and explain the situation - they are likely to also ask them to remove the content and if they don't the site will be frozen pending investigation. The next step is court and most people will not want things to go that far... especially when they are in the wrong.

i got mail respond like that from paypal
they give me advise and refer to them when i ask about something. =P

I am still dealing with these issues. After using copyscape to see my work in a different county and different language (the only thing I could understand was my name was NOT credited) I have written the host and certified letters to no avail. In the States I have sent certified letters and the sites have been taken down and people kicked out of the blog areas for doing such things. Problem is in other countries good luck.
