I had sold an item almost 3 months ago, on Jan 6, and I had mailed out the item with USPS. Since the item is very heavy, I went to the post office to mail the item out instead of printing the labels on paypal. 2 and a half months later, the buyer contacted me, saying that he didn't receive the package. Since it was so long ago, I had already lost the tracking info. I went to the post office to check on the package, in the meantime I offer the buyer a similar item to replace it if he cannot wait for the investigation of the post office. I suspect the buyer to have kept the item to himself, and then claims that he didn't receive the item.

Just earlier this month, the buyer filed a claim against me on paypal. Paypal decided in his favor without even asking me for any documents. Now they are freezing my account. The question is, would paypal take money out from my bank account directly without my consent for the refund? I asked many of my friends, and they said that I should ignore it, since I don't have any money in the paypa account. Would that cause me in any legal trouble, like later on paypal coming after me in small claims court? I had sent the item out, and this situation is the very worst situation that I don't deserve.

Please advise!! Please also tell me any paypal horror stories that you guys have too

I have been taken by a couple of scammers who haved used paypal. I have won everytime. But it takes a while, paypal doesn't just refund you your money when you say I didn't get something. From the times I had to wait I would say paypal gave them more then enough time to reply, respond or take any kind of act. Again this is from the other side of things. I have not gotten the "reverse" scam (if you will) ....YET!

Hmm.. I was just thinking of this legal issue.. What if the person to whom you are claiming payment is beyond your jurisdiction..?? Like for instance, you have sold some item to someone in Asia.. After you have sent the product, you failed to obtain payment.. Since this is an online transaction, what is your recourse..?? It is beyond the jurisdiction of your country right..?? Online transactions are somewhat risky right..? Anyone who knows any legal recourse..? Thanks for your answers in advance..

I think when you link up a bank account to your Paypal account you do give them the right to take money from there to cover a shortage, so yes I think they can take money from your bank account.
