Suppose for example I have a website dedicated to the Beatles.

I make a living selling Beatles merchandise online.

Now suppose I wanted to put a few Beatles songs on my website as background music (within a Flash swf so they couldn't easily be copied by anyone).

Is that breaching copyright? After all I'm not selling that song. It's just an incidental part of my sites appearance.

Any ideas?

Yes it is.

to play music on your website you should have a broadcasting licence OR permission from the copyright holders.
