Make a php script to keep fopen()'ing their websites over and over and over and over...? But isn't that illegal? Denial-of-service and all?

Well, personally if they are illegally spamming then the legality of getting back at them shouldn't really by played by the books. That is just my personal feeling. It comes down to something you see in schools. People skip school which is breaking the rules. They try to make the kids attend by adding more and more rules but they never realize that you cannot enforce more rules on those who don't follow them. You cannot punish those who don't follow the rules with more rules.

EDIT:

There is going to be a P2P based software that does something similar to Blue Frog. By the time I got enough spam to become interested in blue frog, it was already shutdown but there is a google group that is working on a technology to do something similar but by using P2P instead of normal servers.

Once you have tested the avenue of spamming you will realise how lucrative it can be. I mean your so called marketing of myspace is spamming, and look at how much some people make from that. Just swap that to emails and add a little more work and you have email spamming

I take issue with the person who implied that because spamming is illegal then your response should be as well. What right do we have to commit a possibly illegal act in retaliation of an act made against us? When do two wrongs make a right?

However, before you decide what to do, it is a wise choice to take a hard look at what the email sender did. Was it spam or was it not spam?

What is spam?

According to Dictionary.com, spam is unsolicited e-mail, often of a commercial nature, sent indiscriminately to multiple mailing lists, individuals, or newsgroups; junk e-mail.

That said, the real question here is whether what you received was sent indiscriminately and whether it was unsolicited. In my opinion, the other issues appear to be satisfied.

Have you filled out a form on a website? Were you aware of their privacy policy? Perhaps you consented to the email and thus it would not have been unsolicited. You may have consented by filling out such a form on a website, giving someone your email address... I could come up with hundreds of examples but the idea here is that you turned over your email address. Logically, if you turn over your email it makes sense that you are consenting to receive email at that address unless you expressly state otherwise.

Were the emails indiscriminate? Perhaps you were targeted by the email senders for a quality or feature of yours. In this instance, the email you received might not have been indiscriminately sent because the sender discriminated by choosing who to send to and who not to send to.

My point here is that we call things spam without stopping to analyze whether something really fits the definition of spam at all. Surely, if after evaluating the emails they turn out to fit the definition of spam then maybe you could sue the sender. In this instance I would consider trespass, interference with contract, trespass to chattels, etc..

Course of Action
Is Spam illegal? If so, spam is illegal (meaning a criminal wrong) and the emails are spam, then attempt to have the sender prosecuted for their action. Call your local police and say you were spammed. I have a serious doubt about those emails being considered illegal although they may be spam.

Ask a lawyer for more information if you really want to go after a "spammer". Don't just become another vigilante attempting to defend yourself because in the long run, that hurts us all, not just the spammer.

I wouldn't even bother. I find most spam can be tract back to the far east, russia etc, the kind of places warez groups have their servers hosted. They cant be touched it appears, so nailing and trying to sue spammers is definitely one hell of a long shot
I have tried contacting ISP's in the past and irresponsible ones such as British Telecom just keep sending automated replies.

And you're going to have a hell of a time tracking them down. This is a catchall email anyways, so why do you care? Focus on implementing anti-spam measures for the e-mails that you do use.

gmail lets plenty of spam through. i've had the most success with hotmail's exclusive filter personally.
just getting back to the legality of it: regardless of how someone acts towards you, in the common law, you've got a duty towards third parties to act in good faith. the script proposed (while probably good to send a message) would likely fail that test of good faith. but then, what are they gonna do? sue you? "You broke my spam website?"

Anyways, like someone else said: don't waste your time. (Unless there's some worthwhile commercial application...)
