How do forums like passesforthemasses .com not get into any trouble?

they have over 54k threads with pirated content, i don't think it would be a big deal if it was just parts from a movie or song, but they have full movies and full albums uploaded to rapidshare.

But according to the whois their IP is in the US, but I do not know what that means really.

Didnt Lee have a video website? I think he sold one on sitepoint not so long ago..

I'm asking this because i want to start a niche forum and have section for clips, i was thinking of downloading clips from youtube then hosting them on rapidshare.

Any advice?
