What if you left your wallet somewhere and I picked it up. I then proceed to use your name and info to sell ****ty products and/or scam people. I use your diver's license as proof of who I am. I advertise to your friends letting them think I am you, maybe I even sell them a few shady things.
Now, according to some of you, that should be okay. Obviously, you won't say so, but that is a pretty close example to using somebody's MySpace account (no physical losses, etc). If you claim that it's okay to use somebody else's account without their permission, then you are either incredibly selfish and immoral, or just plain ignorant.
I'll go create a MySpace account and let you use it if you give me a list of all your friends and let me use your email address.

I think (no real idea as obviously I dont give a stuff about US laws) its not just 5K in real solid money, but also in "value" and time spent etc too. E.g. a guy over here recently got sent ot the US to face charges because he supposedly caused something like half a million dollars in "damage" to a few military servers when infact all he did was guess the "hello" password on the admin account. Supposedly the costs of the "damage" was going around doing audits, checking everything is still as it should be, checking logs, changing passwords etc etc.

I can't believe we're having this discussion.
Phishing surely is in violation with more than one federal act? It most likely equals jailtime, no matter how you personally justify it.

I don't see why it would be that bad, so long as you didn't actually modify their profile? Sure, it's unethical, but you gotta do what you gotta do.
Isn't MySpace traffic frowned upon by AdSense, by the way?

Jailtime for phishing myspace accounts, lol. I'd go down to the fed prison visit the guy and laugh in his face because he was improsoned for taking some myspace accounts. Also, I heard federal prison is nice.
There are definately no big guys who haven't had lovin' for a while. If I were to choose, I would go to federal prison.

No, I'm still here.
I have heard people did it - the worst that was happened was their URL got filtered out of all of MySpace.
For example, Xenra.com used to generate 60,000 uniques/day using MySpace and phishes. Now, if you try to put that URL anywhere on MySpace, it gets filtered out. Go ahead, and try to post a bulletin saying 'Go to <a href=xenra.com>xenra</a>'
It will be filtered out. You can even see that on the confirm page.

Yeah, I see it. You're like in prison. Some guy says he's in their for a bank robbery. The other guy says he hacked the IRS's database to get a discout on his taxes. They ask you, and you reply by saying you phished an acount on myspace.com. Wow. hehehe... that's freaking halarious.

MySpace is more worried about blocking sexual predators than some kid using a few thousand accounts. The sexual predator stuff is making the news, not the phishing (and I'm not even doing the phishing)

For those of you talking about Federal Prison, and Federal Law. I'm sure most of you being very computer oriented, I'm sure most of you have downloaded movies, music, or programs like Photoshop before. Then there are people who are going to respond that the've never done such a thing before. Great for you. But I'm saying it's your preference and judgement. Millions of people keep on downloading illegal music, even though they know the RIAA is gunning for them.
