My attorney asked me the other day about the possible reasons I could be sued, and we began discussing this. I know anyone can be sued in today's world, but if you do things right what are the possible reasons one in inernet business could be sued? :detective:
I was named in a lawsuit but it was dropped before making it to court. I get threats on a regular basis. Particularly at my coin forum, where the guys take a rather aggressive approach to fraudulent coin listings on Ebay.
Does anyone have liability insurance that would cover suits like this?
I had been threatened to be sued more than once.. Not a pleasant experience. Then again, I've also threatened to sue many more times, and went through with it twice so far. I feel sorry for anyone who gets on the wrong side of my lawyers.
No, I haven't but its always a concern of mine. I regularly make decisions for my sites based on legal concerns, adding disclaimers, consulting my attorney to make sure I think straight.
I think a step to prevent being sued would be some good discalimers and privacy policy. As for reasons for being sued: fraud, copyright violation... I could go on and on...
Slander and Libel are two of the main sue'able (excuse the dodgy word) offenses in my opinion. Especially now that podcasts are so dominant and more and more people are looking towards the web as a focused written media.
Haven't been sued yet but I've been threatened. That's why we LLC'd and I am also in the process of getting an umbrella insurance policy to cover us if we do get sued.
I have been on the other end though. I have taken poeple to small claims court and it's not fun on either side. I hope I never get sued.
As publishing on the Internet starts being taken more seriously, the possibility of being sued will be greater.
Newspapers and other media can be sued, and we're going to fall into the same boat as them. I incorporated earlier this year and wrote a very strong Terms of Service agreement prior to opening.
I've been researching business insurance for publishers, but haven't had too much luck so far.
