WARNING Thunderball Marketing

Hi - I am posting in ecommerce forums so that other business owners can avoid the nightmare I have gone through with Thunderball Marketing.

I became a dealer for them Feb. 2009 and right from the beginning things just weren't right. I was expecting to receive the typical new dealer info with terms and conditions, and procedures for ordering.

Not a chance. Basically it was "thanks for the $1000, and good luck figuring this out." Every question I had was met with a very strange evasiveness or flat out rudeness.

Eventually I figured out how to use their antiquated Telnet (yes I did say telnet) ordering and inventory system. They tell you when you sign up that they are implementing a new online system, but it has not happened after a year of waiting.

Today I decided to close my account with them. I requested they mail the $452 left in my account back to me. They refused to do so saying that their website states this on the front page. I looked and it certainly does not say that. You be the judge -
www tball.com

Since May, when my websiite finally went live, I have sold over $17,000 worth of their merchandise. Today when I asked them to close my account and return my $452 they became unbelievably rude saying they wouldn't deal with me, that I had returned more merchandise than I had sold. I was shocked. I have never returned even one item! In fact I have had to bend over backwards to convince customers to use the warranties to repair defective products they received from this company.

I wrote this Joe Levy guy back (I assume he owns the company, but can't be sure since I never received any real info from them) and told him I thought it was illegal for him to refuse to give me my money back and that I would be forced to take action. Here's his response:

"Go ahead

We have been in business for 35 years

We don’t need dead beat customers"

Can you believe that? Avoid this company like the plague!

This is our first "legit" business transaction. We did not log hours down so we can not charge per hour. Here is what we did and just hoping some of you could read this and give us your personal estimate. We have hand coded a flat-file database system to manage the store items and pictures as well as redesigning all of the graphics and navigation.

Few months back, one of friend wanted some websites developed for his friends. I developed 2 sites for him and he came up with 3rd project. As I have worked previously, I didn't ask for initial deposit of 3rd website.

On completion of 3rd website, he asked me to replace my website's link and put his name (on all 3 websites) to show visitors that he himself developed website.

I told him that I can remove my link as he is owner of websites but I cannot replace it with his name bcz I have worked hard to build my websites portfolio and charged him minimal cost (being my friend).

There is no written contract signed for any of 3 websites. Now he is refusing to pay for 3rd website's development and hosting unless I give website development credits to him.
He is also demanding source code for all 3 websites so that he can get it modified from someone to put his name (as the developer of the sites).

Now some legal questions arising for me are:
1. If I developed and hosted website without a written contract (and the client has paid for it), can I reject handing over the code unless client agrees to formal terms and conditions of external use of code?

2. If the client is refusing to pay for website development and hosting (after the site is live), can legally I put Google Ads on the live website bring some revenue to cover development cost?

3. Can I refuse to continue hosting the 2 previous websites on my server if he is not paying for 3rd website upon completion of the 3rd website?

4. Can I offer him the credits for all 3 websites for extra charges? How much can I charge for this?

Any help/suggestion with above questions is much appreciated.

Lesson I learnt: Always do a contract with a client no matter how simple the project is.

business to accept credit card payments on HIS website without
redirecting to a third party like PayPal Standard payments.

In order to do that, what does he need to do?

I read somewhere that since Sep 30th 2009, in order
to accept credit card payments on your website
you need a PCI compliance certificate?
Is this REALLY true or just a way for consultants to scare up
some business.

What costs are involved with PCI compliance.
I think the client will need to buy some special router
hardware, is that right?

What is the best/simplest user registration + shopping cart solution out there right now?
Here's what I want to do with it.

I want my customers to do 5 simple steps
1)Register
2)Login
3) Fill out contact and shipping info one time only (so they won't have to do it ever again)
4)Add items(or service) to a cart
5)Checkout

This is a equipment repair service website.

My goal is for customers to submit info about a specific device they need to have repaired into a "Service Ticket", then make a payment selection based on their repair request(Overhaul or Estimate), and then checkout. After the payment, they Print out a "service ticket" and put that into a box with the equipment to be repaired and send it in.

The next time they come back they don't have to fill in contact info or shipping info for the "service ticket". that information will automatically populate the ticket. all they do is specify the type on repair and checkout.

The solution i'm looking for should be turnkey, and customizable w/o any coding skills. Just like google apps.

What do you guys think?

Thanks in advance.
