Hi all, hope you can give me some advice. We are a company in the UK, that has registered a .com, .net, .org domain names. Now another rival company without our consent has registered another of our domains as a .co.uk. We are not a LTD company, yet, but do we have a leg to stand on to get this domain that we should rightly own taken away from them?

Very often a solicitors letter suggesting legal action and possible resolution by ICANN is enough.

Are they a close competitor? Have you had contact with them in the past? It's probably just a domain name grab looking for you to buy them out. Unfortunate developments. The lesson might be to grab up the other domains without .co.uk so this doesn't happen again.

I do not thing u can do something for it,, bcz u r not a limited company.. if ur revel is a limited company may be they can do something against u

Wrong!

Being a UK limited company does NOT give any more protection or rights over "cyber squatters"

Owning a registered trade mark on the disputed name can though, maybe you are confusing the two.

The first thing I'd do is talk with a lawyer familiar with internet law. (i.e. before contacting the .co.uk owner) If the .co.uk owner is aware that you exist, chances that they bought the domain name "by mistake" are pretty slim.
Like chrishirst said, often a strongly worded letter from a lawyer is all it takes...and paying a lawyer to write a letter is alot cheaper than paying them to fight a court battle to get the domain.
