Hello,

As many website owners know writing a terms of use/service document can be very daunting and complex.

I have to admit that I am currently using another websites terms of use/service for my website that I just copy pasted and was wondering the legalities of this. Since afterall both our websites need to say the same thing, is it illegal?

I'd think it would still be copy theft. I also wouldn't assume that both sites need to say the same thing.

What you'd be better off doing is to look through the TOS for several sites and use those as a guideline to create your own. That assumes none of your TOS requires a lawyer. If it does then you should consult a lawyer.

There are several sites that have TOS that you can use. Otherwise, just take the main points, and wrap around them.

What kind of site is it? Do you have a legal business name? A LLC or C Corporation? If you have a legal business then yes you should contact a lawyer. As a legal business you should have one already

I think having the advise of the legal council will help you out. Because copying literally is a copy theft same as said by vangogh. I would prefer research and create your own terms and services. peace.
